Terms of Service

These Terms of Service govern the business relationship between This Webdesign (Lukas Thissen, sole proprietorship under Swiss law) and its clients. By commissioning services from This Webdesign, you agree to these terms.


1. Scope of Services

This Webdesign provides web design and web development services, including but not limited to:

  • Website design and layout
  • Website development and programming
  • AI-assisted website analysis and consulting
  • Ongoing maintenance and updates (by separate agreement)

The exact scope of each project is defined in a written offer or project brief agreed upon before work begins.


2. Quotes and Pricing

All prices are quoted in Swiss Francs (CHF) and are exclusive of any applicable VAT unless explicitly stated otherwise. A written quote is provided before the start of each project and is valid for 30 days from the date of issue.

Changes to the project scope after a quote has been accepted may result in revised pricing. This Webdesign will notify the client in writing before proceeding with any out-of-scope work.


3. Project Process

A typical project follows these stages:

  1. Briefing — Client provides project requirements, goals, target audience, and any existing brand materials.
  2. Design — This Webdesign creates design concepts based on the briefing.
  3. Feedback — Client reviews the design and provides written feedback (see Section 7 on revisions).
  4. Development — Approved designs are built and developed.
  5. Review — Client reviews the developed website.
  6. Launch — Website is published once all deliverables are approved and final payment is received.

Timelines are agreed upon at the start of each project. Delays caused by late client feedback or missing content may extend the project timeline accordingly.


4. Client Responsibilities

The client agrees to:

  • Provide all necessary content (text, images, logos, etc.) in a timely manner and in agreed formats
  • Respond to requests for feedback or approval within a reasonable timeframe (typically 5 business days)
  • Hold the rights to any content submitted to This Webdesign for use in the project
  • Ensure all information provided is accurate and does not infringe on the rights of third parties

This Webdesign is not responsible for delays or quality issues resulting from late, incomplete, or insufficient content provided by the client.


5. Payment Terms

  • Deposit: 50% of the agreed project price is due before work begins.
  • Final payment: The remaining 50% is due upon delivery of the completed project, before the website is published or files are transferred.
  • Invoices are payable within 14 days of the invoice date.

In the event of late payment, This Webdesign reserves the right to suspend work until payment is received. Persistent non-payment may result in project cancellation (see Section 9).

For ongoing services or maintenance, a separate payment schedule will be agreed upon in writing.


6. Intellectual Property

Upon receipt of full payment, the client receives full ownership of the final delivered website, including its design and code.

Exceptions:

  • Third-party components (e.g., fonts, stock images, plugins, frameworks) remain subject to their respective third-party licences.
  • This Webdesign retains the right to display the completed project in its portfolio and use it for promotional purposes (e.g., website, social media, case studies), unless the client requests otherwise in writing.

Prior to full payment, all work remains the property of This Webdesign.


7. Revisions

Each project includes 2 rounds of revisions at no additional cost. A revision round consists of one consolidated set of feedback from the client, responded to in full by This Webdesign.

Additional revisions beyond the included 2 rounds will be charged at an hourly rate, communicated to the client in advance.

A revision is defined as adjustments within the agreed design concept. Significant changes to direction, scope, or concept may be treated as a new phase of work and quoted separately.


8. Warranty and Liability

This Webdesign delivers work with professional care and skill. However:

  • No guarantee is made regarding specific business outcomes, such as increased traffic, leads, or revenue resulting from the website.
  • Compatibility: Websites are tested in modern browsers. This Webdesign is not liable for display issues in outdated or unsupported browsers.
  • Third-party services: This Webdesign is not responsible for downtime, data loss, or changes in service by third-party tools (e.g., hosting providers, analytics platforms).

Liability is limited to the value of the project fee paid. This Webdesign is not liable for indirect or consequential damages.


9. Cancellation

Either party may cancel the project in writing with reasonable notice.

  • If the client cancels after work has begun, the deposit is non-refundable. Any work completed beyond the deposit value will be invoiced at the applicable rate.
  • If This Webdesign cancels the project for reasons not attributable to the client, any amounts paid beyond work already delivered will be refunded.

10. Applicable Law and Jurisdiction

These Terms of Service are governed by Swiss law. Any disputes arising from this contractual relationship shall be subject to the exclusive jurisdiction of the courts of [KANTON], Switzerland.


11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
